2. Terms and definitions
2.1. User – any person who visits the Platform, views Offers and/or makes a Reservation/Purchase.
2.2. Customer – User who makes a Reservation/Purchase and makes a payment.
2.3. Host/Organizer/Supplier – a third party (natural or legal person) that offers an Experience, Accommodation, Event or Tour through the Platform.
2.4. Offer – a page/ad on the Platform with a description, terms, price, availability and specific rules of a specific Experience/Accommodation/Event/Tour.
2.5. Experience – culinary/cultural/tourist experience (incl. class, tasting, workshop, etc.).
2.6. Accommodation – accommodation service offered through the Platform.
2.7. Event/Tour – an organized event or tour with a specific date/time/route.
2.8. Voucher – a prepaid voucher for a certain value, which can be used to pay for Offers on the Platform, under the terms of section 9.
2.9. Deposit – part of the total price payable online through the Platform when booking an Experience/Accommodation. The balance is paid directly to the Host, unless otherwise stated in the Offer.
2.10. Reservation deadline – minimum period before the performance/accommodation date in which a reservation can be made by default (section 8).
2.11. Cancellation deadline – a period within which the Customer may cancel by default (section 8), unless the Offer provides otherwise.
3. Purpose and role of the Platform
3.1. The platform provides an online environment for:
- publishing Offers from Hosts/Organizers;
- accepting reservations/purchases;
- accepting online payments (deposit/100%/vouchers) and issuing confirmations.
3.2. Unless explicitly stated, the Administrator is not a Service Provider., and an intermediary/organizer of the reservation and payment process. The contract for the provision of the specific Experience/Accommodation/Event/Tour is concluded between the Client and the respective Provider under the terms of the Offer and these General Terms and Conditions.
3.3. For Offers where The Provider is the Administrator himself. (if any), the contract is concluded between the Client and the Administrator.
4. Access, registration and profiles
4.1. The Platform can be used with or without registration, unless a functionality requires a profile (e.g. order/voucher tracking).
4.2. The User declares that he/she provides accurate information and will not misuse the Platform.
4.3. The Platform is intended for persons over 18 years of age. Minors may participate in Experiences only under the conditions described in the specific Offer and/or with the consent of a parent/guardian.
5. “Add an offer” – applying and publishing offers (for Hosts)
5.1. Anyone interested can apply as fill out the “Add Offer/Application” form”.
5.2. The administrator reviews the application and may request additional information/evidence.
5.3. Upon approval, the candidate:
- receives confirmation as a Host on the Platform;
- accepts a contract for Hosts (electronic);
- sends its Offers by submitting the following form.
5.4. The Administrator reserves the right to Reject or remove Offer, if: it is incomplete, misleading, violates the law/rights of third parties, contains inappropriate content or creates a risk for the Platform/Users.
5.5. The Host is responsible for: legality of its activities, quality and safety of the service, accuracy of the information in the Offer, availability and actual performance.
6. Reservation/Purchase Process
6.1. The client selects an Offer, date/parameters (number of guests, etc.) and proceeds to payment.
6.2. The reservation/purchase is considered accepted after successful payment and confirmation by email/in the profile.
6.3. The administrator may apply anti-fraud mechanisms and refuse an order in case of suspected abuse.
7. Prices and payments – general rules
7.1. All prices are in euro (EUR), unless otherwise stated.
7.2. Payment is made online using available methods (e.g. card/other integrations). The platform does not store card data if the payment provider does not provide such a function under legal requirements.
7.3. In case of discrepancy between the description and price/terms published in the Offer, the confirmed parameters in the order and the Offer at the time of purchase shall be valid.
7.4. The administrator may charge service/transaction fee, if clearly stated before finalizing the purchase.
8. Specific payment rules according to product type
8.1. Experiences, Accommodation and Tours – deposit through the Platform, balance with the Host/The organizer
a) In these Offers, the Customer pays deposit online through the Platform.
b) The remainder of the price (total price minus deposit) is payable directly to the Hostess/The organizer in a manner and at a time described in the Offer (e.g. on site, upon check-in, by bank transfer, etc.).
c) The amount of the deposit is specified in the Offer and/or in the checkout process.
d) The deposit is part of the total price and serves to guarantee the reservation.
8.2. Events – 100% advance payment through the Platform
a) In the event of Events, the Client pays 100% of the value online through the Platform, unless the Offer states otherwise.
b) The reservation is valid only after successful payment and confirmation.
8.3. Vouchers – 100% payment through the Platform
a) The voucher is for specific monetary value and can be used for all Offers on Experiences.Pendara.bg under the terms of section 9.
b) The voucher is paid 100% online through the Platform.
9. Vouchers – rules of use
9.1. Vouchers are for a specific monetary value and can be used for all Offers on the Platform, unless a restriction is explicitly stated in a specific Offer. Validity period: 12 (twelve) months from the date of issue/purchase.
9.2. The voucher is provided electronically (code/document) and is used when checkout on the Platform, unless the Customer has explicitly chosen additional physical delivery in accordance with clause 9.6.
9.3. The voucher is one-time – can be used just once, for one reservation/purchase within the Platform. After use (in whole or in part) the voucher is considered exhausted and cannot be reused.
9.4. The voucher not exchangeable for cash и not subject to refund, cancellation, deduction or compensation, once purchased, unless applicable law requires otherwise.
9.5. If the Customer/User chooses to book an Experience/Accommodation/Event/Tour on higher value of the voucher's face value, pays the difference through the Platform when finalizing the reservation/purchase. If the selected Offer is of a lower value than the face value of the voucher, the difference is not refundable and is not transferred as a balance.
9.6. At the Customer's option, the voucher can also be provided via physical delivery, when the Platform offers such an option. Shipping is at the buyer's expense., at the prices of the selected courier – Speedy or Econt – according to the tariffs and conditions of the respective courier, as well as according to the selected service (to office/to address, etc.). Delivery times are approximate and depend on the courier.
9.7. In case of lost/deleted voucher code, the Client should contact the Administrator for assistance after identification. The Administrator may refuse assistance in case of reasonable suspicion of misuse or when the right to use cannot be established.
10. Default booking and cancellation deadlines
Important: The Offer may contain different terms. If the Offer states otherwise, it has an advantage in front of the “default” rules below.
10.1. Reservation period (default)
- Experiences and Events: reservations are accepted at the latest 7 days before the date of the event.
- Accommodation and Tours: reservations are accepted at the latest 14 days before the check-in date.
10.2. Cancellation period (default)
- Experiences and Events: free cancellation up to 7 days before the date.
- Accommodation and Tours: free cancellation up to 14 days before the check-in date.
10.3. Effect of cancellation before the deadline
- for Experiences/Accommodation/Tours (deposit) – by default the deposit is refunded to 50%, unless the Offer provides otherwise;
- for Events (100% prepayment) – default the amount paid is refunded to 50%, unless the Offer provides otherwise.
10.4. Effect of cancellation after the deadline / no-show
a) In case of cancellation after the specified deadlines or in case of no-show:
- for Experiences/Accommodation/Tours (deposit) – by default the deposit is not refundable, unless the Offer provides otherwise;
- for Events (100% prepayment) – by default the amount paid is not refundable, unless the Offer provides otherwise.
b) Exceptionally, with the consent of the Host/Organizer, it may be offered rescheduling or credit/voucher, under conditions described in the Offer or in individual communication.
10.4. How to request a cancellation
Cancellation is requested in writing (e.g. via profile/form or email), with the Client receiving confirmation of the accepted cancellation.
11. Change/cancellation by Host/Organizer and force majeure
11.1. If the Host/Organizer cancels or cannot perform the service, the Client has the right to:
- rescheduling or
- recovery of the amounts paid to the Platform (deposit/100%), unless the Offer specifies another mechanism (e.g. alternative date).
11.2. In the event of force majeure (natural disasters, severe weather conditions, extraordinary restrictions, etc.), the parties shall seek a reasonable solution - rescheduling, voucher/credit or refund according to the specific case and the law.
12. Responsibilities
12.1. The Host/Organizer is responsible for the actual provision of the service, its safety, quality, legal permits, as well as for the accuracy of the description in the Offer.
12.2. The administrator is responsible for the functioning of the Platform and for the correct processing of payments, but does not guarantee that the service will meet subjective expectations beyond what is described in the Offer.
12.3. The Platform is not liable for damages caused by actions/inactions of the Host or third parties, unless otherwise provided by law.
12.4. The Client is obliged to comply with the instructions of the Host and the rules of the venue.
13. User Content, Reviews and Code of Conduct
13.1. The User does not publish illegal, offensive, misleading or proprietary content.
13.2. The administrator may remove content and/or restrict access in case of violation.
14. Intellectual property
14.1. The design, texts, structure and elements of the Platform are protected.
14.2. Copying/use without permission is not permitted, except within the scope of legal exceptions.
15. Personal data and cookies
15.1. Personal data is processed in accordance with Privacy Policy of the Platform and applicable legislation.
15.2. The platform may use cookies for: login/sessions, remembering preferences, statistics, protection against abuse, etc.
15.3. Standard cases are possible such as: comments (if active), uploaded media, embedded elements from other sites, security logs, etc., described in detail in the Privacy Policy.
16. Complaints and dispute resolution
16.1. Complaints and reports are sent to the Administrator's contact email.
16.2. In the event of a dispute, the parties shall strive for a voluntary settlement. If this is impossible, the dispute shall be resolved in accordance with the applicable Bulgarian legislation.
16.3. Users may also contact the competent authorities (e.g. CPC, CPDP, etc.).
17. Final provisions
17.1. The Administrator may update the General Terms and Conditions. Changes shall enter into force upon their publication, unless otherwise stated.
17.2. If a clause proves to be invalid, the remaining provisions shall remain in force.
17.3. The current legislation of the Republic of Bulgaria shall apply to unresolved issues.
